Man Arrested After Farting in Police Officer’s Face

There’s a first for everything. A West Virginia man may be the first person to ever be charged with passing gas after he farted in a police officer’s face.

Jose Cruz was driving with his car’s headlights off when he was pulled over by West Charleston, West Virginia, police officers. They noted that the 34-year-old appeared to be intoxicated and asked Cruz to complete a series of field sobriety tests.

After Cruz failed the sobriety tests, he was arrested and taken to police headquarters, where he allegedly “lifted his leg and passed gas loudly on Patrolman Parsons. The defendant then fanned the air with his hand in front of his rear onto” the officer. Apparently, “the gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons.”

Cruz did admit to farting “multiple times” and fanning the fetid air toward the officer but insisted that it was in retaliation for the cop insisting he take a breath test while he was having an asthma attack. “I said, ‘Here, put that in your Breathalyzer,'” Cruz said.

In addition to the DUI count, Cruz was also charged with battery on a police officer for the farting incident. After posting a $500 bond, Cruz was released from a Charleston jail where he had been held on the misdemeanor charges.
